Wisconsin Supreme Court refuses to hear Green Bay clergy sex abuse suit

Associated Press/September 3, 2008

Milwaukee - The Wisconsin Supreme Court has refused to hear a sexual abuse victim's lawsuit against the Roman Catholic Diocese of Green Bay, effectively ending the case.

David Schauer was 10 when a priest at a parish school abused him in 1988. Former priest Donald Buzanowski was sentenced in 2005 to 32 years in prison for felony child sexual assault.

The now 30-year-old Schauer sued Buzanowski, the diocese, the school and their insurers in 2003. An appeals court ruled in May that a trial court correctly concluded the statute of limitations had expired.

Schauer argued the time limit shouldn't apply because a church official warned his mother in 1990 not to take legal action.

Schauer says he hopes state law will be changed to let him pursue his case.
